TERMS & CONDITIONS
The terms and conditions stated herein (collectively, the “Agreement”) constitute a legal agreement between you and Qourier, a limited company existing under the laws of the Republic of Singapore (the “Company”). In order to use the Qourier services, you must agree to the terms and conditions that are set out below.
Qourier “online” (i.e. web and mobile services, which includes web sites operated by Qourier such as www.qourier.com, mobile applications, however accessed and/or used via personal computers, mobile devices or otherwise) and “offline” (i.e. collection of data through electronic or surface mailings, telephone, or in person) activities owned, operated, provided, or made available by the company. Qourier “online” and “offline” activities are collectively termed as the “Services”.
By using or receiving any services supplied to you by the company, you hereby expressly acknowledge and agree to be bound by the terms and conditions of the agreement, and any future amendments and additions to this agreement as published from time to time through the services.
The company reserves the right to modify the terms and conditions of this agreement or its policies relating to the service or software at any time, effective upon posting of an updated version of this agreement on the service or software. You are responsible for regularly reviewing this agreement. Continued use of the service or software after any such changes shall constitute your consent to such changes.
The company contracts individuals, independent logistics carrier third party to offer courier services, which may be scheduled through use of the software, or service. The company has no responsibility or liability for any courier other than stated herein services provided to you by such individuals or third parties.
Qourier services are not available to persons under the age of 16. By using the software or services, you represent and warrant that you are at least 16 years old. By using Qourier services, you represent and warrant that you have the right, authority and capacity to enter into this agreement and to abide by the terms and conditions of this agreement. Your participation in using the services is for your sole, personal use.
You may not authorize others to use your user status, and you may not assign or otherwise transfer your user account to any other person or entity. When using the services you agree to comply with all applicable laws of the Republic of Singapore. You may only access the services using authorized means.
Termination of access
Qourier may, in its sole and absolute discretion, discontinue, suspend or modify your and /or any other user’s access to the company’s services or any portion there of at any time with or without notice and/or for any other reason. The company reserves the right to terminate this agreement should you be using the services with an incompatible or unauthorized manner.
- Reverse engineer or access the services’ software in order to:
- Build competitive services
- Build a product using similar ideas, features, functions or graphics of the service or software, or
- Copy any ideas, features, functions or graphics of the services
- Launch an automated program or script, including, but not limited to, web spiders, web crawlers, web robots, web ants, web indexers, bots, viruses or worms, or any program which may make multiple server requests per second, or unduly burdens or hinders the operation and/or performance of the service or software.
- Send spam or otherwise duplicative or unsolicited messages in violation of applicable laws.
- Attempt to gain unauthorized access to the software or service or its related systems or networks.
Delivery request information
You agree that your delivery request with the Company represents that the information supplied by you is accurate and complete. Your delivery request with the Company also acknowledges that the Company is relying upon such information in the preparation and completion of each and all request without any verification by the Company as to its accuracy or completeness. You agree to hold the Company and its parent, subsidiaries, directors, officers, employees, affiliates, successors, assigns, agents and representatives harmless and defend and indemnify the Company from and against any claims, causes of action, damages and liability of whatever kind or nature, including but not limited to court costs and reasonable attorney fees if information provided by you or your agent is inaccurate or incomplete. It is your responsibility to inform the Company of any changes or corrections to your information.
Delivery Job Price / Payment terms
- would cause the aggregate amount of stored value held by Qourier, directly or indirectly, alone or together with any person over whom the Qourier has control or influence, to exceed any value permitted under the prevailing laws and regulations
Delivery Job Processing Fees
The company charges a processing fee (20%) for all delivery jobs transactions . The remaining of the delivery fees will be re-credited to the individuals or independent logistics carrier third party that offer the courier services. The processing fee may be modified or updated by Qourier from time to time. It is your own responsibility to remain informed about the processing fees.
Intellectual property ownership
Disclaimer of warranties
- The use of the services will be timely, uninterrupted or error-free or operate in combination with any other hardware, software, system or data,
- The services will meet your requirements or expectations,
- Any stored data will be accurate or reliable,
- The quality of services, information, or other material purchased or obtained by you through the service will meet your requirements or expectations,
- Errors or defects in the services will be corrected, or
- The service or the server(s) that make the service available are free of viruses or other harmful components.
Preferred Pickup/Delivery Time Slots
Third Party Couriers
Responsibility for the decisions you make regarding services offered via the company (with all its implications) rests solely with you. We will not assess the suitability, legality or ability of any such individuals, third party licensors and/or vendors and you expressly waive and release the company from any and all liability, claims, causes of action, or damages arising from your use of the services, or in any way related to the third parties introduced to you by the services.
Qourier Quality Assurance
The quality of the courier services scheduled through the use of the service or software is entirely the responsibility of the individual or third party provider who ultimately provides such courier services to you. You understand, therefore, that by using Qourier services, your package(s) may be exposed to situations that are potentially dangerous, offensive, harmful to minors, unsafe or otherwise objectionable, and that you use Qourier services at your own risk.
Qourier’s maximum liability for each delivery request is SGD $100 or the declared value of the delivery request, whichever is lower. Qourier, however shall not be liable under any circumstances for paper-related and food-related items such as documents, cooked food, packed food, etc. Liability is subjected to approval and confirmation by Qourier. All claims are only refundable via Qourier Credits.
Filing of Claims
- Your violation or breach of any term of this agreement or any applicable law or regulation, whether or not referenced herein;
- Your violation of any rights of any third party, including providers of courier services arranged via Qourier services, Or
- Your use or misuse of Qourier services.
The company’s services may be subject to limitations, delays, and other problems inherent in the use of the Internet and electronic communications. The company is not responsible for any delays, delivery failures, or other damage resulting from such problems.
Qourier services timing may be subject to prevailing weather conditions. Slight delays in pick up and/or delivery timing may occur in the event of poor weather in Singapore. The company is not responsible for any delays, delivery failures, or other damage resulting from such problems.
Unforeseen Road Conditions
Qourier services timing may be subject to prevailing road conditions. Slight delays in pick up and/or delivery timing may occur during peak periods and eves of public holidays as such due to rush hours. The company is not responsible for any delays, delivery failures, or other damage resulting from such problems.
General Package Conditions
Qourier will not be liable for your acts or omissions including but not limited to improper and/or insufficient packing, securing, marking, indications, and/or addressing of locations or to recipients.
Failure to Complete A Delivery
Absence of Recipient
In the event that the Recipient is found to be absent from the Delivery Address specified by the Sender and no other person is present to receive the Parcel(s) on behalf of the Recipient, the Courier will call the Recipient for further instructions on whether to leave the Parcel(s) with the neighbour or leave the Parcel(s) at the doorstep. If the Recipient is unreachable, the Courier will call the Sender to request for further instructions on how to proceed. If there is a need, Qourier will arrange for a redelivery to the same address free of charge.
In the event whereby the Recipient is found to be absent from the Delivery Address and the Sender requests for the Courier to return the Parcel(s) back to the original location. An additional surcharge (Price of the original job) on top of the delivery fee will be charged to the Sender.
In the event whereby the Sender cannot be contacted as well, the Sender hereby authorises Qourier to decide on the Sender’s behalf.
Item not ready for Pickup
In the event whereby a Pickup is not successful due to the courier being late to reach the Sender for reasons that are not the Client’s responsibility, Qourier will contact the Sender to re-arrange a pickup either at different location or different day/timing.
Absence of Recipient
In the event whereby a Pickup is not successful because the item is not ready during the scheduled pickup timing, the Courier will seek further instructions from the Sender on whether to wait for the parcel or to pickup the parcel at a later timing. $4 no pickup surcharge will be imposed. Couriers will wait for a maximum of 10 minutes at the Pickup Address.
You recognise that Qourier’s ability to provide the Delivery Services is dependent on the accuracy of the Delivery Information. You acknowledge that Qourier shall not be liable for any breach of these Terms and Conditions caused by any inaccuracy in such information, and that you will be liable to pay for any additional charges arising as a result of such inaccurate data. An additional $10 Surcharge will be applicable and charged to the Sender for the waiting time our courier had to spend due to inaccurate or lack of information.
Change of Address by Sender
In the event whereby the sender wishes to change the delivery address after the courier has picked up the item, an additional $10 Surcharge will be applicable and charged to the Sender. In any case if the courier refuses to deliver the item to the new delivery address, the Courier will bring back the item to the Sender, no additional surcharge will be implemented. However, the original delivery fees will still apply.
Change of Address by Recipient
In the event whereby the recipient wishes to change the delivery address after the Courier has picked up the item, the Courier will call the Sender to request for further instructions on how to proceed. If the Sender cannot be contacted as well, the Sender hereby authorises Qourier to decide on the Sender’s behalf. Qourier reserves the right to reject the request by the recipient in this case and the delivery will be on-hold until further instructions are given from the Sender. If an agreement is tied up between the Sender and Recipient to resend it to the same delivery address, Qourier will arrange for a redelivery to the same address free of charge.
A $10 Surcharge will be implemented on the Sender if the Sender agrees to the recipient‘s request to resend it to a different address. Depending on the Courier‘s availability, Qourier will make arrangements either for the original Courier to deliver the parcel or a new Courier to take over the delivery.
Rejection of Parcel by Recipient
In the event whereby the recipient refuses to accept the parcel, the Courier will call the Sender to request further instructions on how to proceed. Should the Sender request for the Courier to return it back to the original location, an additional surcharge (price of the original job) on top of the delivery fee will be charged to the Sender. If an agreement is tied up between the Sender and Recipient to resend it to the same delivery address, Qourier will arrange a redelivery to the same address free of charge.
In the event where the Sender cannot be contacted as well, the item will be sent back to Qourier while waiting for further instructions from the Sender.
